1Acceptance and operator
SIMSIM is operated by SIMSIM Global Commerce ("SIMSIM", "we", "us" or "our"), headquartered in Mumbai, India. These Terms form a binding agreement between SIMSIM and the person or organisation using the platform ("you" or "user"). If you use SIMSIM for an organisation, you confirm that you have authority to bind that organisation.
If you do not agree, do not create an account or use the platform.
2Services
SIMSIM provides technology tools that may include vehicle and FASTag location searches, saved tracking history, map displays, consent-based SIM location services, reports, account credits, payment workflows and support features. Certain results and functions depend on third-party telecommunications, toll, mapping, payment and infrastructure providers.
SIMSIM is an information and tracking platform. It is not an emergency service, law-enforcement system, navigation guarantee, or substitute for independent verification.
3Eligibility
- You must be at least 18 years old and legally capable of entering a contract.
- Registration details must be accurate, complete and kept current.
- Business users must have all internal approvals required to use the services.
- We may refuse or restrict registration where necessary for security, compliance or service integrity.
4Vehicle and SIM authorisation
You may search, add or track only a vehicle, mobile number, SIM or person that you own, control, manage, or are otherwise lawfully authorised to monitor. You must not use SIMSIM to stalk, harass, intimidate, discriminate against, secretly monitor, or invade the privacy of another person.
SIM consent
SIM location access is consent-based. You are responsible for providing any legally required notice and obtaining valid permission from the subscriber, driver, employee or other relevant person. Provider consent requests may be delivered by SMS, link, IVR or another approved channel. Tracking may remain unavailable while consent is pending, may expire, and may stop after withdrawal or provider rejection.
Vehicle data
You confirm that each vehicle number submitted is accurate and that your access to its location or toll information is lawful. You must promptly remove a vehicle or SIM when your authority ends.
5Account security
- Keep your mobile number, PIN and session access confidential.
- Do not share an account in a way that defeats access controls or accountability.
- Notify us promptly if you suspect unauthorised access.
- You are responsible for activity performed through your account unless applicable law provides otherwise.
- We may temporarily lock, suspend or verify an account to protect users and the platform.
6Credits, plans and payments
Some services consume platform credits. The applicable credit cost, plan details, taxes, payment options, offer conditions and validity, if any, are shown within the platform or at checkout and may be updated prospectively. Completing a payment does not override eligibility, consent, technical availability or acceptable-use requirements.
Automatic payments may be processed by an authorised payment gateway. Manual payment requests remain pending until verified. False, altered, duplicate or misleading payment proof may result in rejection or account suspension. Refunds, reversals and failed transactions are handled according to the displayed plan conditions, payment-provider rules and applicable law.
7Acceptable use
You must not:
- use the platform unlawfully or violate privacy, telecom, traffic, intellectual-property or other rights;
- use consent or messaging functions for unsolicited promotions, or breach applicable telecom, DND or subscriber-preference requirements;
- scrape, copy, resell, sublicense, reverse engineer or commercially exploit the platform or provider data without written permission;
- circumvent consent, credits, rate limits, authentication or security controls;
- upload malware, make automated abusive requests, interfere with availability, or test vulnerabilities without written approval;
- submit false identifiers, payment evidence, consent information or support requests;
- use location information to cause harm or make a high-risk decision without independent verification.
8Personal data and confidentiality
Our handling of personal data is described in the Privacy Policy. You must have a lawful basis and provide required notices for personal data that you submit. You must maintain appropriate confidentiality and security for downloaded reports, maps, location history and account information.
Non-public platform documentation, technical material and business information supplied to you remains confidential and may be used only for authorised use of SIMSIM.
9Third-party services and availability
Location, toll, address, operator, consent and map information may be delayed, incomplete, duplicated, unavailable or inaccurate because it originates from external networks and providers. Geographic coordinates may occasionally require validation or correction. You must independently verify information before relying on it.
We may perform maintenance, modify features, apply usage controls, change providers, or temporarily interrupt access. We do not promise uninterrupted, error-free or real-time availability. Emergency maintenance and events outside reasonable control may occur without advance notice.
10Intellectual property
SIMSIM and its licensors retain all rights in the platform, branding, software, interfaces, documentation, databases, designs and related technology. These Terms grant only a limited, revocable, non-exclusive and non-transferable right to use the platform for its intended purpose. Third-party maps, data and services remain subject to their respective rights and notices.
11Disclaimers and liability
To the maximum extent permitted by law, the platform is provided on an "as available" basis. We disclaim implied warranties of uninterrupted availability, accuracy, merchantability, fitness for a particular purpose and non-infringement where such disclaimers are lawful.
SIMSIM is not responsible for decisions based solely on location or toll information, loss caused by unauthorised account use that you failed to report, provider or network outages, or indirect, incidental, special or consequential loss, except where liability cannot legally be excluded. Nothing in these Terms excludes rights or liabilities that cannot be excluded under applicable law.
You agree to indemnify SIMSIM against third-party claims arising from your unlawful tracking, lack of required authority or consent, misuse of data, infringement of rights, or material breach of these Terms, subject to applicable law.
12Suspension and termination
You may stop using SIMSIM and request account closure. We may suspend or terminate access for non-payment, security risk, unlawful activity, abuse, breach of these Terms, loss of required consent or authority, provider restrictions, or legal and regulatory requirements. Provisions concerning accrued obligations, confidentiality, intellectual property, disclaimers, liability and dispute resolution survive termination where applicable.
13Changes to these Terms
We may update these Terms to reflect service, provider, security, operational or legal changes. The current version and effective date will be published here. Where a change materially affects your rights, we will provide reasonable notice through the platform or available contact details when required.
14Governing law and disputes
These Terms are governed by the laws of India. You should first contact us and allow a reasonable opportunity to resolve a concern. Subject to mandatory law and any agreed dispute process, courts with jurisdiction in Mumbai, Maharashtra will have jurisdiction over disputes relating to these Terms or the platform.
